Except for the limited right to use the Service under these Terms, no rights are granted to you, whether by implication, estoppel, or otherwise.
The Service may integrate with or rely on third-party services, including authentication providers, analytics services, cloud infrastructure, payment platforms, and app stores. Your use of those services may be subject to their separate terms and privacy policies.
We are not responsible for the availability, accuracy, security, or practices of third-party services.
Your use of Habiora is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied.
We do not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, or suitable for your particular needs. We do not guarantee that using Habiora will result in any particular habit, productivity, wellness, or personal outcome.
Habiora does not provide medical advice, diagnosis, treatment, therapy, or professional health guidance. Any habit suggestions, reminders, progress indicators, or other content are for general informational and organizational purposes only.
Do not rely on Habiora as a substitute for qualified professional advice. If you have a health concern or emergency, contact an appropriately qualified professional or emergency service.
To the maximum extent permitted by law, Habiora and its owners, operators, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or business opportunities arising from or related to your use of or inability to use the Service.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid to Habiora for the Service during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US$100) if you have not made any payment.
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Habiora and its owners, operators, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from your User Content, your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may suspend, restrict, or terminate your access to the Service if we reasonably believe that you have violated these Terms, created risk for Habiora or other users, engaged in unlawful conduct, or used the Service in a way that may harm its operation or security.
You may stop using the Service at any time. If you wish to delete your account, use the available in-app account deletion feature or contact us at hello@habiora.co.
Sections that by their nature should survive termination, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions, will survive termination.
We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, to the extent permitted by law.
We may also update these Terms from time to time. The updated version will be posted with a revised “Last updated” date. Your continued use of the Service after the updated Terms become effective means that you accept the changes.
These Terms will be governed by the laws applicable in the jurisdiction where Habiora is legally established, without regard to conflict-of-law principles, unless applicable law requires otherwise.
Before bringing a formal claim, you agree to contact us at hello@habiora.co and make a good-faith effort to resolve the dispute informally.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
These Terms constitute the entire agreement between you and Habiora concerning the Service and supersede prior agreements relating to the Service.
